These Terms of Use (“Terms”) govern your access to and use of ChargeRoute mobile applications and related services (the “Service”) operated by Gather Media (“we”, “us”, or “our”). By downloading, accessing, or using the Service, you agree to these Terms.
1. The Service
ChargeRoute provides tools to discover charging stations, plan EV trips, estimate range-related stops, and navigate with charging guidance. Features may vary by device, region, vehicle profile, and subscription status. We may modify, suspend, or discontinue features at any time.
2. Eligibility and accounts
- You must be legally able to enter into these Terms in your jurisdiction.
- You are responsible for the accuracy of account information and for keeping login credentials secure.
- You are responsible for activity under your account.
3. Acceptable use
You agree not to:
- Misuse the Service, interfere with its operation, or attempt unauthorized access.
- Scrape, reverse engineer, or copy the Service except as allowed by law.
- Submit unlawful, harmful, misleading, or infringing content (including station reviews).
- Use the Service in a way that distracts you from safe driving or violates traffic laws.
4. Driving and navigation disclaimer
ChargeRoute is a planning and guidance aid, not a substitute for your judgment, vehicle instruments, or applicable traffic rules. Route suggestions, ETAs, station availability, power levels, and range estimates can be incomplete, delayed, or inaccurate. Always prioritize road safety. Do not interact with your phone while driving; use vehicle-integrated modes (such as Android Auto or CarPlay) only where legal and safe.
5. Third-party data and services
The Service may rely on third-party maps, station data, weather, traffic, authentication, app stores, and vehicle-screen platforms. We do not control those services and are not responsible for their availability, accuracy, or terms.
6. Community content
If you post comments, ratings, or other content, you grant us a non-exclusive, worldwide, royalty-free license to host, use, reproduce, and display that content in connection with the Service. You represent that you have the rights to submit the content and that it does not violate others’ rights.
7. Intellectual property
The Service, including software, branding, design, and content we provide, is owned by Gather Media or its licensors and is protected by intellectual property laws. These Terms do not transfer ownership to you. You may use the Service only as permitted herein.
8. Premium features and payments
Some features may be offered as paid or subscription options through the Apple App Store or Google Play. Purchases are processed by those platforms under their terms. Refunds, billing, and cancellations are handled according to the applicable store’s policies unless otherwise required by law.
9. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you also acknowledge that policy.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT STATION OR ROUTE INFORMATION WILL BE ACCURATE OR COMPLETE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GATHER MEDIA AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR FIFTY US DOLLARS (OR EQUIVALENT).
12. Indemnity
You agree to defend and indemnify Gather Media from claims arising out of your misuse of the Service, your content, or your violation of these Terms or applicable law.
13. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Provisions that by nature should survive (including disclaimers and limitations) will survive termination.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on this page and revise the “Last updated” date. Continued use after changes constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles, unless mandatory consumer protections in your country of residence provide otherwise.
